FACILITY AGREEMENT FOR STUDENTS AND NON-BOARDERS

WITNESS THIS AGREEMENT this          day of                       , 2005, by and between Montana Sport Horses LLC,
hereinafter referred to as “Stable,”  and                                              , hereinafter referred to as “Rider.”

1. Inherent Risks and Assumption of Risks. The undersigned acknowledges there are inherent risks associated
with equine activities and in consideration of the use of the grounds and facilities owned by MONTANA SPORT
HORSES LLC and Ann and Dave Womack, located at 3910 – 53rd Ave SW, Great Falls, Montana, I (We) hereby
waive, release and forever discharge any and all rights and claims for personal injury or damages which I may
accrue to me against MONTANA SPORT HORSES LLC, Ann and Dave Womack and their heirs, agents and
representatives. I understand that this is a high risk sport and I am participating at my own risk. I hereby assume
full responsibility for any and all risks of bodily injury, death, loss of or injury to personal property, and any and all
expenses associated therewith, both for myself and for the horse I am riding, and shall indemnify and hold
harmless Montana Sport Horses and Ann and Dave Womack from any such damages or injury.


2.  Rider Acknowledges and Agrees to:
a)        Regulation ASTM  helmets with secure harness will be worn by all youth riders. Any adult rider who
chooses not to wear head gear while riding on the flat does so at their own risk and by signing this agreement
explicitly agrees that the Stable will not be held liable in any way, shape or form. ALL Riders will wear regulation
ASTM helmets while jumping.

b)        Suitable footwear with a heel will be worn by all Riders.

c)        Rider will replace or pay for any damage caused by any horse they have brought to the facility.


d)        Rider will provide a cooperative attitude facilitating the smooth operation of the barn activities and the
enjoyment of the facility by all Riders.

e)        Rider will clean up after their horse in the wash rack and barn aisle and clean all manure the horse leaves
in the barn aisle promptly.


f)        Rider will pick up after their horse (manure, mess, loose hair, etc) in the tack up area AND on the riding
surface of the indoor arena. Manure should also be removed from walk ways to and from the indoor arena.

g)        If the Rider uses blankets, saddle pads, polos, tack or equipment owned by the barn, the Rider is
responsible to wash/clean and return items to the barn and repair any damage caused promptly. This does not
apply to Students using school horses.


h)        Riders will NOT borrow or use tack or equipment belonging to another Owner without the EXPRESS
permission of said Owner.

i)        Riders will provide a cooperative effort to keep the common area of the tack rooms clean and tidy.

j)        Do not let your horse, rub, chew or otherwise abuse the white railing in the arena.

The above paragraph applies to students using school horses as well as those bringing their own horses to the
facility except as noted.

3. Arena Etiquette.
Do not mount or otherwise congregate in the entrance to the riding area of the indoor arena.
Take your horse and/or mounting block to the interior of the arena (preferably not on the center line or at X) to
mount or dismount. If possible have someone remove the mounting block from the arena after you are on your
horse.

When riding in an arena with more than one horse is present it is customary for the slower horse to take the
inside track. The rider behind you may call out “rail” which should indicate to you to move over to the inside, if you
haven’t already noticed them. If you are going in the opposite direction to the other horse riders should pass each
other left hand to left hand.

When upper level horses are working in the arena be aware that they are not apt to stay on the rail as they are
working on more difficult school figures incorporating the diagonals, centerline, smaller circles, lateral work, etc. In
general, experienced riders are more maneuverable and will navigate their way around the arena with more skill
and so more novice riders should not feel intimidated. As long as you try to keep to the basic rules, experienced
riders should be capable of continuing their work. If a mishap does occur, a pleasant “sorry” and a smile should
work. If novice riders have questions or need help the experienced rider should be gracious and advise and help
where they can.

Arena footing is expensive and takes a great deal of maintenance. If everyone does their part and picks up the
manure after each ride we all benefit from being able to ride on better footing.

It would be appreciated if you would pick out your horse’s feet prior to leaving the indoor if you plan to walk your
horse through the barn aisle after riding. The barn aisle is swept umpteen times a day and any reduction is much
appreciated.
